ACA & Regulatory Updates:
The Future of Premium Tax Credits

The U.S. House of Representatives recently passed legislation to extend enhanced Affordable Care Act (ACA) premium tax credits (EPTCs) for an additional three years. This bill, currently under negotiation in the Senate, aims to stabilize insurance markets and prevent premium spikes for consumers. As legislative discussions continue, industry stakeholders are monitoring the potential for a bipartisan compromise that may introduce new income caps and adjustments to open enrollment periods

Medicare:
2026 Payment Plan and Enrollment Resources

As of June 2026, beneficiaries are seeing the rollout of the Medicare Prescription Payment Plan. This new program allows enrollees to spread their out-of-pocket (OOP) drug costs over the course of the plan year rather than paying them in full at the pharmacy. The maximum OOP cost for covered Part D drugs in 2026 is set at $2,100. Additionally, the Medicare Payment Advisory Commission (MedPAC) issued its June report, highlighting the increasing complexity of enrollment decisions and providing guidance on improving payment incentives and reducing improper payments across Medicare Advantage and fee-for-service plans.

Expanding Flexibility for Employers

Individual Coverage Health Reimbursement Arrangements (ICHRA) continue to be a focal point for employer-sponsored health benefits in 2026. Recent analysis emphasizes the importance of maintaining strict class rules when offering an ICHRA, as these arrangements allow employers to reimburse employees for individual market policies with greater budget control. Employers are reminded that they cannot provide coverage that supplements Medicare for active employees, and must adhere to specific "affordability" calculations based on the lowest-cost silver plan in their region.
